Contract:

This website, www.JalaSai.com, (hereinafter referred to as "JalaSai.com") is a digital real estate advertising / marketing and information services platform connecting people with the real estate market. JalaSai.com and our subsidiaries and affiliates (collectively the "Company" or "JalaSai.com" ) provide you with access to a variety of services, including but not limited to the JalaSai.com website (the "Website" ) and JalaSai.com's mobile applications (the “Mobile App” ) and all the products and services available through our Website and Mobile App (collectively the "Services"). The Website and Mobile App. is owned, hosted and operated by JalaSai Estate Consultancy, a real estate firm and having its registered office at 32, vrajvihar6, Opp. gloriya restarant, Prerantirth dersar Road, Ahmedabad-380015.

It is mandatory for all Users of the Website to have read carefully, fully understood and be in total agreement to the below mentioned Terms before they proceed to use any of the services of the Website ("Services"). The Services are available only to those individuals, firms or companies who can form legally binding contracts under the Indian laws. Company may amend these Terms of Use at any time by posting the amended version on this site. Such amended version shall automatically be effective upon its posting on this site.

These terms and conditions regulating use of these Services constitute a legally binding agreement between JalaSai.com and the User (the "Agreement").. By using or visiting website, mobile applications, software, data feeds, and services provided to you (collectively the "Service" ) you signify your agreement to these terms and conditions (the "Terms of Service") and privacy policy (the "Privacy Policy") of the Company. If you do not agree to any of these terms, please do not use the Service.

"User" or "You" means any person as an individual or corporate subscriber for the Services and/or the signatory who access or visit WebSite, Mobile Apps, software, data feeds, and/or any Service provided by the Company.

"Agreement" Shall mean an acceptance of the terms and conditions stated herein by the User. It shall deemed to have been executed at Ahmedabad city of Gujarat State in INDIA. These terms of use (Terms) constitute a legally binding agreement between you and JalaSai.com (the "Company") regarding your use of the web site i.e. www.JalaSai.com (the "WebSite") and any services offered by the company including but not limited to delivery of content via the WebSite, any Mobile App or internet connected device or otherwise (the "the Service"). "Date of Registration": Is the date indicating the user registration with the Company by mean of sign in to WebSite/Mobile Application to avail the Service. It shall be specified by the company in it s notice to the user either through e-mail or conventional mail.

"Services": Means the Services to be provided by the Company to the User of JalaSai.com and shall include the provision of following facilities:

Service to the Users wishing to post their profile or listing for the purpose of sale/rental of their property, and for users providing property services etc..

Service to the Users who wishes to secure a property through JalaSai.com and its Internet links.

Service to the users who wishes to place a print advertisement in any of the group publications through the JalaSai.com WebSite.

Service to the Users who wishes to insert advertisements at JalaSai.com.

Service to the Users who wishes to receive advertisements and promotional messages on JalaSai.com and through emails.

"JalaSai.com": Is defined as the Internet web site of the Company at JalaSai.com

Cancellation:

JalaSai.com shall reserve the exclusive right to cancel any content whatsoever from being published or reflected on its WebSite or in any other mode. The cancellation charges if any payable to the User shall be at the applicable rates laid down in the cancellation and refund policy.

Obligations of User/Subscriber:

The accuracy of the Registration Data given to the Company on initial registration process for the Service shall be the sole responsibility of the User.

The user agrees that any data entered into herein will be subject to verification process by JalaSai.com

It is solely your responsibility to evaluate the accuracy, completeness and usefulness of all opinions, advice, Services, real estate and other related information listed on the WebSite. JalaSai.com does not warrant that the access to website will be uninterrupted or error-free or that defects in website will be corrected.

The User agrees and expressly states that he/she is solely responsible for the accuracy and completeness of the Registration Data and other information given to the Company in the application for Membership in order to use the Service. The User will ensure that the data shared with JalaSai.com doesn't contain any fraudulent, false, misleading or manipulated facts.

The User agrees to have / have acquired all the necessary rights and authorizations before posting any information on the Site including but not limited to listing information, property descriptions, photographs, maps, layouts, contact information etc.

In case a User is covered under the RERDA, it shall ensure all necessary compliance necessary, including but not limited to obtaining the necessary registrations etc.

The Site may also require the User to support his/her claims with respect to the status of the property with such documents as may be specified by it from time to time.

The User is responsible for the set-up or configuration of all the necessary equipment required to access the Service.

The User will comply with all notices or instructions given by the Company from time to time in respect of the use of the Service.

The User shall be solely responsible for all information retrieved, stored and transmitted through the Service by him.

The User is solely responsible for the maintenance of confidentiality of the login information.

This would include the User's password and Username and all activities and transmission performed by the User at JalaSai.com.

The User will immediately notify the Company of any unauthorized use of the User's account or any other breach of security known to the User.

The User will pay promptly the Subscription Fees if any as required by the Company from time to time.

The User will take all such measures as may be necessary (including without limitation changing his password from time to time) to protect the secrecy.

In case you chose to discontinue your association with us, you can unsubscribe / remove your account by completing the delisting procedure using the Remove Account link available in your folder.

Prohibited Use:

The User shall not put to use the Services offered by the Site in any manner that impairs the interests and functioning of the Site and which is non-compliant with laws and regulations including RERDA.

The User will not allow any person other than the authorized person(s) named to use the Service.

The User shall use the Service only for the purpose for which it is subscribed.

The User will comply with all applicable laws and shall not contravene any applicable law of India relating to the Services, including any regulation made pursuant thereto.

The User shall not to use the Service for any unlawful purpose including without limitation criminal purposes.

The User shall not to use the Service to send or receive any message, which is offensive on moral, religious, racial or political grounds or of an offensive, vulgar, obscene, malicious or menacing nature.

The User shall be prohibited in persistently sending messages or make postings on JalaSai.com to any other User or third party who access JalaSai.com without reasonable cause or for causing any peril, harassment, annoyance, irritation, or anxiety to any person.

The User is prohibited to introduce, upload, post, distribute, publish or transmit any information or software that:

Contains a virus, worm or other harmful component into the Internet or JalaSai.com network system.

Breaches on any intellectual property rights of any person or retain information in any computer system or otherwise with such intention.

Is unlawful, or which may potentially be perceived as being abusive, defamatory, libelous, harmful, threatening, harassing, vulgar, obscene, or racially, ethnically, or otherwise objectionable.

Is meant to mislead or deceive the other Users

Infringes any trademark, patent or copyright rights

In the event of a violation of any of the above mentioned covenants by the User, and same comes to the Company's knowledge, the Company shall have the right to delete any material relating to the violations without prior notice to the User. The Company shall issue a warning to the User to discontinue any activity, which leads to the said violations, and in the event the User continues with such activity, the Company has the sole authority to terminate or suspend the membership at JalaSai.com and/or any other related facility. In addition to the right to indemnity available to the Company, the Company shall have the right to any legal remedy, against the User to recover the loss suffered by the Company and the harm caused to the goodwill of the Company, due to such violation by the User.

Representation by JalaSai.com:

THE CONTENT OF IS PROVIDED "AS IS" AND ON AN "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OR REPRESENTATIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED.

The Site has no expertise in the domain of intellectual property rights of anyone. It is beyond our scope to verify that the User of the Site have posted ONLY products and services on which they have complete authorization / ownership / dealership / selling rights. As an INTERMEDIARY, our role is limited and in case you have any concern related to copyright infringement then we shall appreciate if the same is to be brought to our notice. The Site neither advocates / endorses such products that may be deemed to be infringing by the virtue of their being listed on the Site nor does it endorse the infringement by removing such listings.

Views expressed by the Users are their own, IEIL does not endorse the same and shall not be responsible for them. No claim as to the accuracy and correctness of the information on the site is made although every attempt is made to ensure that the content is not misleading/ offensive/ inappropriate. In case any inaccuracy is or otherwise improper content is sighted on the website, please report it to report abuse.

JalaSai.com does not take responsibility or liability for the actions, products, content and services on the Website and / or Mobile App, if any, which are linked to Affiliates and / or third party websites using APIs or otherwise. JalaSai.com will not be liable for any damages of any kind arising out of or relating to the use or the inability to use its Website and / or Mobile App, its content or links, including but not limited to damages caused by or related to errors, omissions, interruptions, defects, delay in operation or transmission, computer virus, line failure and all other direct, indirect, special, incidental, punitive, loss of profit, exemplary or consequential damages whether based on warranty, contract, tort or any other legal theory including Force Majeure, and whether or not, such organizations or entities were intimated or advised of the possibility of such damages. You agree to defend, indemnify, and hold harmlessJalaSai.com and/ or its associates, subsidiaries, their officers, directors, employees, affiliates, licensees, business partners and agents, from and against any claims, actions or demands, including without limitation reasonable legal and accounting fees, alleging or resulting from your use of any material or your breach of these terms and conditions or any applicable law.

JalaSai.com does not facilitate or participate in any manner in the process of selling, buying, renting etc. of properties, and it is not responsible for any dealing, negotiations, transactions, etc. whatsoever between the parties connected through our Services, including and not limited to any quality assurance, guarantee, claim etc. given by one party to another in any transaction. JalaSai.com will not be party to any legal proceedings between parties contracted through these Services. In case JalaSai.comis sought to be implicated in any legal proceedings, costs will be recovered from the party that names JalaSai.com as a party to such proceedings.

1. The user should conduct checks and establish authenticity of any property, or project, its title, built up area, suitability for buying / renting in a form and manner deemed appropriate at his or her cost.

2. JalaSai.com being an advertising platform does not and cannot validate the authenticity of content in its Services. A lot of content is uploaded by the advertiser and we do not filter or verify the same. If a complaint is made, we will take remedial measures.

3. Certain points to bear in mind:

(a) Conduct a comprehensive check of ownership to verify owners' / landlords’ credentials.

(b) Visit the project site/property personally, to ensure that the seller’s / landlord’s claim is genuine and that the property is not an 'imaginary' one.

(c) Beware of false title documents. Loans may have been secured against properties that may be disputed or have remained vacant for long.

(d) We strongly recommend that proper due diligence on the property is conducted prior to entering into a transaction related to a real estate.

(e) It should be independently ensured by the User whether the seller is complying with the provisions of Real Estate (Regulation and Development) Act 2016 and its applicability to the relevant property or project.

JalaSai.com is an advertising and marketing platform to many developer for their real estate projects (hereinafter referred to as “Project”) andis in no way facilitating, negotiating or assisting in the sales between you and the developer. While displaying this information on our Website / Mobile App, JalaSai.com is relying on the information as provided by the Developer of such Project. Before making any decision please ensure to validate all the information and go through the terms and conditions as included in the documents. Further:

a. While reasonable efforts are being made to ensure the meaningful information being displayed by the REPs and the same being asked to be updated by REPs on regular intervals, there is a possibility that the information displayed may not be current and complete.

b. The pictures / photos shown here include artist’s impression of the Project. The actual properties may vary from such representations.

c. Users should verify the completeness and accuracy of all such information from the RERA website, as may be applicable, of respective States where the Project is registered. JalaSai.com does not, by any means verify, validate, endorse or promote the compliance of a specific Project with the RERA regulations.

d. Please make sure you verify all the details independently from the REPs or from the RERA website before making any decision in relation to the purchase of the properties.

This information shall in no way be considered as an advertisement or offer to sale from the REPs or JalaSai.com. JalaSai.com shall neither be responsible nor liable for any inaccuracy in the information provided here and therefore the Users are requested to independently validate the information from the respective developers before making their decision for purchase of properties. JalaSai.com , its directors, employees, agents and other representatives shall not be liable for any action taken, cost / expenses / losses incurred, by you, based on the information given on the portal.

JalaSai.com attempts to be as accurate as possible. However, JalaSai.com does not warrant that descriptions of or content of this site is accurate, complete, reliable, current, or error-free. Also, your access to the Services may also be occasionally suspended or restricted to allow for repairs, maintenance, or the introduction of new facilities or at any time without prior notice. We will attempt to limit the frequency and duration of any such suspension or restriction. JalaSai.com provides links to other sites over which JalaSai.com has no control. JalaSai.com is not responsible for the availability of such external sites or resources and does not endorse and is not responsible or liable for any content, advertising, products or other material on or available from such sites or resources

CONFIDENTIALITY:

For the purpose of this Agreement and attachments thereto and all renewals, " Confidential Information " means all financial, commercial, technical, operational, staff, management and other information, data and know-how relating to the Project or to a party (the " Disclosing Party " herein the Company ) or any other members of the Disclosing Party's group of companies ( including, without limitation, as to products and services, assets, customers, date and database, suppliers or employees), which may be supplied to or may otherwise com e into the possession of the other (the " Receiving Party ", herein the User ), whether orally or in writing or in any other form, and which is confidential or proprietary in nature or otherwise expressed by the Disclosing Party or by any of its Associates to be confidential, and not generally available to the public.

As JalaSai.com is an online platform so it cannot guarantee confidentiality of information provided by Users who use the Site, so any breach in privacy due to technical fault or any other means is not the responsibility of JalaSai.com.

The Receiving Party shall keep confidential and secret and not disclose to any third party the Confidential Information nor any part of it, except to any of the Receiving Party's Associates, if required and upon prior permission in writing from the Disclosing Party. The Receiving Party agrees to take all possible precautions with regard to protecting confidential information from any third party and shall ensure that all its Associates to whom such disclosure e is made will act in accordance with the terms of this Agreement as if each of them were a party to this Agreement, and if required obtain a written statement from each of its employees/associates having access to such Proprietary Information undertaking to abide by the confidentiality conditions. All Proprietary Information shall be kept separate and exclusive and at the usual place of business (or residence as the case may be) of the Receiving Party.

Further no use, reproduction, transformation or storage of the Proprietary Information shall be made by the User without the prior written permission of the Company, except where required to be disclosed pursuant to any applicable law or legal process issued by any court or the rules of any competent regulatory body.

The User is entitled access to his own data and information stored in the database at JalaSai.com (subject to prior confirmation of identity) and may edit or amend such data and information at any time.

The Users need to be aware that when they voluntarily reveal identification oriented information (name, e-mail address) to anyone resulting in unsolicited messages from third parties then such interaction is beyond the control and liability of JalaSai.com.

JalaSai.com is liable to share all information available with it in response to any legal proceedings including and not restricted to court orders, notices, subpoena, FIR etc.

The copyright, know how or any other related intellectual property to the Service or JalaSai.com shall be the sole and exclusive property of the Company. In the event the User has contributed any content to JalaSai.com in any manner whatsoever, the intellectual property of the same shall stand automatically assigned to the Company and the User shall have no right or claim over the same. In the event the User during the term of his agreement or any time thereafter, uses such intellectual property in any other website or related activity, the same can be construed to be an infringement of the intellectual property belonging to the Company and the Company shall have the right to legal recourse in this regard.

LIMITATION OF LIABILITY:

JalaSai.com only offers a platform to showcase the property related information ( including but not limited to properties to be sold / rent / lease and the requirement of properties for purchase / lease etc) and has no role in any transaction or communications and hence neither JalaSai.com nor its group companies, directors, officers or employee shall be liable for any loss or damage of any sort arising out of the use and/or temporary or permanent discontinuation of its services. Notwithstanding anything to the contrary contained herein, JalaSai.com, liability to you for any cause whatsoever, and regardless of the form of the action, will at all times be limited to the amount paid, if any, by you to JalaSai.com, for the Service during the term of membership.

JalaSai.com being a public site with free access assumes no liability for the quality and genuineness of responses. JalaSai.com cannot monitor the responses received by any User in response to the information posted by them and so displayed on the site. User should conduct its own background checks on the bonafide nature of all response(s). JalaSai.com will not be liable for any inaccuracy of information on this website.

JalaSai.com expressly disclaims any liability arising due to presence of any fraudulent information published on the site.

The Company takes no responsibility/liability whatsoever for shortage or non fulfillment of the service/s on JalaSai.com or any other related site due to or arising out of technical failure or/and malfunctioning or/and otherwise and the User hereby undertakes that in such situation/s, the User shall not claim any right/damages/ relief, etc against the Company for "Deficiency of service" under The Consumer Protection Act or any other Act/Rules, etc.

JalaSai.com shall not be liable for any and all costs, charges, expenses, etc incurred in relation to the downloading fees by third party, airtime, ISP connection costs, etc., of which are to be borne by the user personally.

JalaSai.com shall not be responsible for any malfunctioning, non-functioning of the mobile phone or any other application, and or any damage, loss, either direct or indirect arising out of the use of the JalaSai.com mobile application on your mobile phone.

DISCLAIMER:

Disclaimer of Warranties: The User shall agree that use of the service e is at the user's sole risk. The service is provided on an "as is" or/and on an "as available" basis. Magicbricks.com expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to the implied warranties of merchantability, fitness for a particular purpose and non-infringement.

The Company/JalaSai.com makes no warranty that the service shall meet user's requirements, that the service shall be uninterrupted or/and timely or/and secure or/and error free; nor does Magicbricks.com make any warranty as to the results that may be obtained from the use of the service or as to the accuracy or reliability of any information obtained from the service. Cancellations and alterations shall be effected only on the receipt of application regarding the same in writing.

There are no express representations and warranties, whether express or implied, made by the Company regarding the accuracy and/or quality of any information transmitted and/or obtained through the use of the Services or JalaSai.com.

JalaSai.com will not be liable for any time difference arising between a message released through a gateway/ server ( provided to JalaSai.com ) and such message finally reaching the End User from the concerned service provider.

The Company shall not be liable for any disclosure of information concerning the User's account and/or particular s nor for any error and/or omissions and/or inaccuracy with regard to information so disclosed. In addition The Company shall further not be liable for any loss or damages sustained by reason of such disclosure, weather intentionally or inadvertently.

In case the there is any loss of information, caused due to any reason, weather as a result of any disruption of service, suspension and/or termination of the Service, the Company shall not be liable in any way for the same. Further the Company is not responsible for the accuracy, quality and/or contents of any information available, received and/or transmitted through this Service.

All information are accepted in good faith and JalaSai.com accept no responsibility whatsoever regarding the bonafide of the user, nor can any interviews be granted or/and correspondence entered into regarding any advertisement published.

The User shall ensure that while using the Service, all prevailing and applicable laws, rules and regulations, directly or indirectly for the use of systems, service or equipment shall at all times, be strictly complied with by the User and the Company shall not be liable in any manner whatsoever for default of any nature regarding the same, by the User.

The Company does not warrant that JalaSai.com or any of the web sites linked to JalaSai.com be free of any operational hazards or error s nor that it will be free of any virus or/and worm or/and any other harmful components.

It is not the Company's policy to exercise any kind of supervisory or editorial control over and/or edit and/or amend any data and/or contents of any e-mails and/or posting of any information that that may be inserted or/and made available or transmitted to a third party in or through JalaSai.com and the User acknowledges the same. The User acknowledges and agrees that the Company has absolute discretion to refuse and/or suspend or/and terminate and/or delete and/or amend any artwork, materials and/or information or/and content of any data and/or information or/and posting so as, in the sole opinion of the Company, to comply with the prevailing legal framework and/or moral obligations as placed on the Company and in order to avoid infringing any third party's rights and/or any other rules and/or standards and/or codes of practices that may be applicable to the posting or JalaSai.com and/or the internet.

JalaSai.com is not involved in any transaction between any parties who are using our website. There are risks, which the User assumes when dealing with people who might be acting under false pretences and the same shall be borne by the User. The website is a venue only and do not screen or/and censor or/and otherwise control the listings offered to other Users, nor does JalaSai.com screen or/and censor or/and otherwise control the Users of its service. JalaSai.com cannot and does not control the behaviour of the participants on this site. We cannot control whether or not Users of JalaSai.com will complete the transactions they describe on our site. It is extremely important that the user takes care throughout his dealings with other people, users on this site. JalaSai.com does not accept or/and assume responsibility for the content or/and context of the user comment.

If there is any dispute between the Users/participants on this site, it is agreed upon by the Users/participants that JalaSai.com has no obligation whatsoever to be involved in any such dispute/s. In the event that the user has a dispute with one or more User/s or/and participant/s, the User hereby undertake s not to make any claims or/and demands or/and damages (actual or/and consequential) of every kind or/and nature or/and known or/and unknown or/and suspected or/and unsuspected or/and disclosed or/and undisclosed, arising out of or/and in any way related to such disputes and/or our service against the company or/and their officers or/and employees or/and agents or/and successors.

The User understands and agrees that any information or/and material and/or goods or/and services obtained through this website is done at user's own discretion and risk and that user shall be solely responsible for any damage/s or/and cost or/and any other consequence/s resulting from any transaction.

No advice or or/any information, whether oral or/and written, obtained by the User from JalaSai.com or/and through or/and from the service shall create any warranty not expressly stated herein.

In case a visitor to the portal is desirous of conducting a site visit of the property he/she is interested in, it shall be the sole liability and duty of the Advertiser to arrange for such site visits. The Company/JalaSai.com shall not be liable in any manner whatsoever, towards any liability and/or costs, arising out of such site visits including but not limited to non-fulfillment by the Advertiser in this regard.

The website's total liability under this Agreement in any circumstance shall be limited to the total amount of fees or/and charges paid by the User to the Company's website or the period immediately preceding two (2) months prior to the incident giving rise to the relevant claim.

This Website/ E-mail are vulnerable to data corruption, interception, tampering, viruses as well as delivery errors and we do not accept liability for any consequence that may arise therefrom.

The Platinum Listing is listed for a period of two weeks only from the day the Order is activated. JalaSai.com shall not be liable for any delay arising from the User's end in conversion of their property listing to Platinum Listing, resulting in the Platinum Ad listing not being showcased for the complete period of two weeks. This package cannot be transferred, adjusted or reimbursed.

JalaSai.com shall not be responsible for the advice, views and suggestions provided by the expert. The information contained herein should be used for reference only. Before relying on any such advice, please do an independent assessment at your end considering your specific requirements and the parameters you have in mind. JalaSai.com will not be responsible for any claims arising out of the use of any information displayed herein.

GOVERNING LAW, ARBITRATION & JURISDICTION :

Decision of the Arbitrator shall be final and binding on both the parties to the dispute. The place of arbitration shall be Ahmedabad. The Arbitration & Conciliation Act, 1996, shall govern the arbitration proceedings.

Courts at Ahmedabad, India alone shall have the exclusive jurisdiction in all matters relating to JalaSai.com and these terms and conditions, irrespective of the territory and jurisdiction of your access to JalaSai.com.
